This policy applies to all individuals registered on the WorkWhile platform, including workers, clients, and WorkWhile employees, regardless of whether the conduct occurs during a WorkWhile-related shift or outside of active platform engagement. This policy does not limit the scope of the WorkWhile Harassment and Code of Conduct policies, and works together with them.
Definition of Off-Platform Conduct:
Off-platform conduct refers to any behavior, actions, or communications that occur outside of the direct WorkWhile platform environment (e.g., in-person interactions outside of a scheduled shift, social media posts, private messages, public statements) but are related to or impact WorkWhile, its clients, or its workers.
Prohibited Off-Platform Conduct:
The following types of off-platform conduct are prohibited and may lead to disciplinary action:
Harassment, Discrimination, or Bullying: Any form of harassment, discrimination, bullying, or intimidation directed towards WorkWhile employees, clients, or other workers, based on characteristics such as race, color, religion, sex, sexual orientation, gender identity, national origin, age, disability, or any other protected characteristic. This includes, but is not limited to, verbal abuse, threats, derogatory comments, or discriminatory actions.
Violence or Threats of Violence: Any act or credible threat of violence towards WorkWhile employees, clients, or other workers.
Illegal Activities: Engaging in illegal activities that are directly related to or impact the WorkWhile platform, its operations, or its users. This includes, but is not limited to, fraud, theft, or other criminal offenses.
Defamation or Malicious Falsehoods: Spreading false, misleading, or defamatory statements about WorkWhile, its clients, or its workers that cause harm to reputation or business.
Breach of Confidentiality: Unauthorized disclosure of confidential information obtained through WorkWhile, including client information, worker data, or proprietary business information.
Misrepresentation: Falsely representing oneself as an official WorkWhile representative or using the WorkWhile brand in an unauthorized or misleading manner.
Actions Undermining Platform Integrity: Any off-platform behavior that directly or indirectly undermines the safety, security, or integrity of the WorkWhile platform, its processes, or its community. This includes encouraging or facilitating "off-platform" direct hiring that circumvents WorkWhile's terms of service.
Gross Misconduct: Any other off-platform conduct that WorkWhile, in its sole discretion, deems to be gross misconduct that reflects negatively on the platform, poses a risk to its users, or significantly disrupts its operations.
Consequences of Non-Compliance:
WorkWhile takes all allegations of prohibited off-platform conduct seriously. Any confirmed instance of such conduct will result in disciplinary action, which may include, but is not limited to:
Formal Warning: A documented warning will be issued and recorded in the individual's WorkWhile profile.
Temporary Suspension: For significant or repeated violations, a temporary suspension from accessing or offering opportunities on the WorkWhile platform may be imposed.
Permanent Removal from the Platform: Severe or repeated instances of prohibited off-platform conduct, particularly those involving harassment, violence, illegal activities, or significant harm to the WorkWhile community or brand, will result in immediate and permanent removal from the WorkWhile platform. Individuals removed from the platform will no longer be eligible to accept or offer work through WorkWhile.
Legal Action: In instances of illegal activity, significant harm, or where required by law, WorkWhile reserves the right to pursue legal action against the individual(s) involved and cooperate with law enforcement agencies.
Reporting Violations:
WorkWhile encourages all individuals to report any suspected instances of prohibited off-platform conduct. Reports can be made through trust-and-safety@workwhilejobs.com or via the Support chat in the WorkWhile app. All reports will be investigated promptly and thoroughly. Retaliation against anyone who reports suspected violations in good faith is strictly prohibited and will result in disciplinary action.
Policy Acknowledgment:
By using the WorkWhile platform, all individuals agree to abide by this Off-Platform Conduct Policy. Understanding and adhering to this policy is a condition of maintaining access to and participation on the WorkWhile platform.
WorkWhile reserves the right to modify this policy at any time, with notice provided to all platform users.
