Key terms to help with your transition

A quick reference for the terms you'll see in your agreement and on invoices

Your engagement is governed by WorkWhile's Terms of Service, Services Agreement, and Privacy Policy. To make things easy, we have summarized a few of the key terms.


Direct hire / conversion fee

You may hire any WorkWhile worker directly at any time. A conversion fee of $1,000 applies, prorated based on the total number of hours the worker has completed through WorkWhile. The fee decreases proportionally as hours are worked and reaches $0 at 480 hours.


Back up workers

If WorkWhile has agreed to provide back up workers and more workers arrive than you requested, you will not be charged for any workers beyond your requested headcount.


Tips and gratuity

WorkWhile workers are always compensated at or above minimum wage to ensure fair pay. Tips are entirely voluntary under WorkWhile's terms, and there is no minimum gratuity obligation. If tips are applicable, they will be reflected on your regular invoice in accordance with WorkWhile's standard billing cycle.


Cancellation fees

Cancellations made more than 24 hours before the shift start time incur no fee. Cancellations within 24 hours of the shift start time will result in a fee equal to 100% of the engagement cost.


Pay practices

WorkWhile's standard workweek runs Sunday through Saturday. Workers are paid for all hours worked. WorkWhile does not round any time entries. By default, workers are restricted from scheduling beyond 40 hours per week. To the extent overtime is worked, it will be paid in accordance with applicable law and billed to the client with the standard markup.


Billing cadence

Invoices are issued four times per month based on standard billing periods. If a billing date falls on a weekend or holiday, invoices will be sent the next business day. Invoices include a PDF summary and an Excel file with shift-level detail. See Customer Payment & Invoicing FAQ for more information.


Payment methods and late payments

WorkWhile accepts ACH, wire transfer, Bill.com, check, and automatic billing via Stripe. Clients who prefer to pay by credit card or direct debit ACH may enroll in automatic billing (pay-as-you-go). A 1.5% monthly finance charge applies to past-due balances. See Customer Payment & Invoicing FAQ for more information.


Legal terms

WorkWhile's terms are governed by California law and include a 30-day informal resolution period, followed by binding arbitration. Claims must be brought on an individual basis, as the agreement includes a class action waiver.
